A decade after signing a Patent Prosecution Highway (PPH) MOU with Japan in 2013, Indonesia signed another important PPH MOU with South Korea on 8 September 2023.
Through the PPH mechanism, patent applicants can expedite the examination process for their patent applications in Indonesia. This acceleration is achieved by using substantive examination results issued by the patent offices of countries that have established a PPH MOU with Indonesia’s Directorate General of Intellectual Property Rights (DGIP), specifically the Korean Intellectual Property Office (KIPO) and the Japan Patent Office (JPO). Without the PPH, the examination process typically spans approximately 2 years from the date the application is filed until it receives a substantive examination result. However, with the PPH, the 2-year duration can be reduced to only six months, counted from the date the PPH request is filed. This acceleration substantially reduces the overall time frame for the patent application and registration process.
Applicants can file the request for PPH via Indonesia’s patent e-filing system, as soon as the application is published, and before the first office action is issued.
The PPH programme showcases the genuine support and commitment of the Indonesian Government toward fostering Korean and Japanese investments in Indonesia.
