Indonesia increases its FEE$$$$!

The Indonesian government has increased its’ official fees for a range of IP prosecution actions and has amended its’ Trademark Law.

New Official Fees:

Good news is that not all of the fees have been increased. Bad news is that there is a 100% increase in some parts. This change has become effective since 10 November 2016.

Some of the new changes to the official fees are as follows:

a) Patent Application

From IDR 750,000 (USD 56) for up to 10 claims and up to 30 pages of specification, the new fee is now IDR 1.5 million (USD 111).

b) Trademark Application

From IDR 1 million (USD 74) for up to 10 items of goods/services per class, with every subsequent 1-10 items of goods/ services exceeding the first 10 items, incurring an additional official fee of IDR 1 million, the new fee is now IDR 2 million per class (USD 148) (without limitation, on the number of goods/services)

New Trademark Law:

The Indonesian Government has approved its new Trademark Law and it became effective on 26 November 2016. The new Trademark Law introduces a number of changes to the registration, protection, and enforcement of trademarks in Indonesia.

The new changes to the Trademarks Act are as follows:

a) Non Traditional Marks are now accepted

Sound marks, 3D shape marks and hologram marks.

b) Easier to Obtain a Filing Date

Minimum requirements have been put in place to obtain a filing date –only the representation of a trademark and payment of fees is required.

c) Renewals Made Simpler too

A renewal application of trademark registration can be filed within 6months before the renewal due date andlate filing of a renewal application may be filed within a 6 months grace period after the expiry date by paying penalty fees.

d) Restructing of Examination Process

Previously marks are published after All trademarks that pass an initial formal examination will proceed directly to the publication stage, and only then they will enter the substantive examination stage. There will be no further publication after the substantive examination.
