WHAT’S IN A DESIGN?
KASS registered a series of Industrial Designs in respect of shape and configuration of an anchorage lug (brackets) used in earth retention wall mounting system for a leading civil engineering firm in Malaysia.
Contested Design
All the designs were registered by the Malaysian Intellectual Property Office (MyIPO) under Registration No.: MY 03-00185
A competitor of clients challenged the validity of registration of one of the industrial designs on various grounds. After hearing the arguments on both sides, MyIPO ruled the design registration was valid.
Not satisfied with the decision, the competitor appealed against the decision to the High Court. Again, after reviewing the arguments submitted by both sides, the High Court upheld the decision of MyIPO and dismissed the appeal with costs.
Now clients have a range of industrial designs on an anchorage lug exclusive for their use or to license the designs to third parties.
KASS is pleased with the decision, the success coming soon after its earlier success in a trademark matter (EMMER ZECNA).
