The Myanmar Intellectual Property Department (IPD) initiated the first step for trademark registration under the new Trademark Law through the establishment of an online filing system (WIPO File), with the soft opening period commencing on 1 October 2020.
After over a year in this soft opening period, the IPD recently called for a training for the Representative of Trademark Registration (1/2022) from 25 February to 1 March 2022. Updates from the training are as follows:
- Each WIPO File user is required to attend the training and pass the subsequent the exam in order to become a certified representative.
- As previously mentioned, new trademark applications will require a TM2 form (Appointment of Representative form). The form has been drafted and the official version will be available on the IPD website soon. Each trademark application will require its own TM2 form. The TM2 form must be notarized if the applicant is not domiciled in Myanmar.
- The IPD will charge official fees at the Application stage and Registration stage. Fees will be based on number of classes (per class) and there will be no additional charge for colour claim.
